Products and availability
Killerburst sells new, used, custom, consignment, closeout and other specialized musical instruments and equipment. We make reasonable efforts to describe products accurately and, when stated, photographs may show the actual instrument offered. Colors and details can vary by screen, lighting, manufacturer information and normal product variation.
Inventory may also be offered in the physical store or through another marketplace. An item displayed as available online may occasionally sell elsewhere before the website updates. An order is not accepted until Killerburst confirms the order and payment. If an item is unavailable, we may cancel the order and issue a refund or contact you to discuss alternatives.
Prices, taxes and errors
Prices are shown in U.S. dollars and may change without notice. Applicable taxes, shipping charges and other order costs are displayed during checkout when available. We reserve the right to correct typographical, pricing, product-information or calculation errors and to cancel or adjust an affected order after contacting you.
Orders and payment
You agree to provide current, complete and accurate billing, shipping and contact information. We may limit quantities, decline an order, request additional verification or cancel an order when reasonably necessary to address availability, suspected fraud, payment problems or an error.
Payment and financing options are provided by third parties and are subject to their approval, eligibility requirements, fees and terms. A displayed financing option is not a guarantee of approval. Bank-wire payments are available only by arrangement.
Shipping, returns and trade-ins
Shipping, delivery, returns, evaluation periods, exclusions, special orders, deposits and trade-ins are governed by the Shipping & Returns policy, which is incorporated into these terms. Product-specific language disclosed before purchase also applies. If product-specific terms conflict with the general policy, the terms explicitly agreed upon for that transaction control.
Custom and special orders
Custom instruments and non-stock items ordered specifically for a customer may require a non-refundable deposit and may be non-cancelable and non-returnable. Custom specifications, build schedules, change requests and final pricing may also be subject to the builder’s requirements. Review and approve the applicable order details before authorizing a commission.
Accounts
You are responsible for protecting your account credentials and for activity conducted through your account. Notify Killerburst promptly if you believe an account has been accessed without authorization. We may suspend or close accounts used unlawfully or in violation of these terms.
Website use
You may use the website only for lawful personal or commercial shopping purposes. You may not attempt to interfere with website operation, gain unauthorized access, introduce malicious code, scrape or copy content at scale, misrepresent your identity, or use the website to violate another person’s rights.
Intellectual property
Website design, original text, photography, graphics, logos and other content are owned by Killerburst or used with permission and are protected by applicable intellectual-property laws. Manufacturer names and trademarks belong to their respective owners. No content may be reproduced or commercially used without permission except as allowed by law.
Third-party services and links
The website may use or link to payment, financing, shipping, marketplace, media and other services operated by third parties. Their services are governed by their own terms and policies. Killerburst is not responsible for third-party websites or services outside its reasonable control.
Disclaimers and limitation of liability
To the extent permitted by law, the website and its content are provided on an “as available” basis. We do not guarantee uninterrupted or error-free operation. Killerburst is not liable for indirect, incidental, special or consequential damages arising from use of the website or a third-party service. Nothing in these terms excludes rights or remedies that cannot lawfully be excluded.
Governing law
These terms are governed by the laws of the State of Connecticut, without regard to conflict-of-law principles. Any dispute will be handled in an appropriate court with jurisdiction in Connecticut, unless applicable consumer law requires otherwise.
